Buying Real Estate in Mexico in Simple Terms

I had someone contact me recently who wanted to know the
steps in buying property in Mexico in simple terms. Sure! Buying real estate in
Mexico is a process of acquiring property, like a house, condo, or land, within
the country. Here are the main steps explained in simple terms:
Research: Start by researching the area you are interested in and the type of property you want to buy. Consider factors like location, amenities, and budget.
Engage a Real Estate Agent: It's a good idea to work with a local real estate agent who speaks your language fluently and understands nuances like slang so important factors are not misunderstood in the purchasing process. They can help you find suitable properties and guide you through the process.
Sign an Offer To Formalize An Irrevocable Transfer of Domain Contract (Oferta Para Formalizar Contrato Traslativo De Dominio Irrevocable).
Offer and Negotiation: Make an offer to the seller
through your real estate agent. Negotiate the price, conditions, terms and
chattels until both parties agree on a deal.
For example, common conditions can include:

Financing: A period of time is given for the
buyer to be approved for financing by a lender of their choice.

Property Inspection: Once you find a property
you like, schedule an inspection to check its condition, legal status, and any
potential issues.
· Review of Condominium Documents: The buyer is
provided with meeting minutes, by-laws, and financial documents for the
HOA/condo board which allows them to ensure that there are no unexpected issues
with the property.
For example, common terms can include:
· Repair &/or Replacement: Sometimes there are
items in the home that need to be repaired or replaced at the expense of
the seller on or before the possession date with adequate receipts showing due
completion of the same.
· Cleanliness: Sometimes there is a state of
uncleanliness &/or disorganization on the property that requires it to be
cleaned to the satisfaction of the buyer on or before the possession date
If the offer is accepted, and after conditions are satisfied and waived, a 10% deposit is typically required as well as a retainer for the notario (government appointed real estate lawyer), and the escrow fee.
Title Search and Due Diligence: Your lawyer will perform a title search to ensure the property has a clean legal title and no outstanding debts.
Fideicomiso (Trust): If you are a foreign buyer and are buying property within 50 kilometers (about 31 miles) of the coastline or 100 kilometers (about 62 miles) from the border, and it's not within a restricted zone, you will need to set up a bank trust called a "fideicomiso".
Closing and Escrow: Once all checks are cleared, and everything is in order, you'll proceed to the closing process. The remaining amount will be paid, and the property's ownership will be transferred to your name.
Registration: The property's title and transaction details will be registered with the Public Property Registry to make the purchase legally official.
